State Rep. Bret Roberts sponsored HB 2309 to create a new class 6 felony for protests of seven or more people and prohibiting certain non-violent protest tactics. The legislation was recommended by the Senate minority caucus this past year, and is expected to be considered again in next year’s legislative session.

These Arizona state legislators use conspiracy theories and lies to retain power and sow distrust in the electoral process.

State Rep. Mark Finchem
(R-Oro Valley)

State Representative Mark Finchem is an active far-right militia member.

In 2014, Mark Finchem disclosed that he was a member of the Oath Keepers, one of the largest far-right anti-government groups in the United States.

  • Spread Anti-Government Conspiracy Theories
    The Oath Keepers were founded in 2009 after the election of President Barack Obama, and organized around a set of conspiracy theories about the federal government working to destroy Americans’ liberties.
  • Worked to Overturn the 2020 Election Results
    The group has participated in multiple standoffs with federal officials and openly urged President Trump to reject the results of the 2020 election and remain in office.

Arizona Legislators Attempted to Overturn Election Results

Thirteen Arizona state legislators supported overturning results of the 2020 Presidential election.

  • On December 10, 2020, an amicus brief signed by 13 Arizona state legislators was filed in the Supreme Court of the United States supporting overturning the election results.
  • When that didn’t work, the Arizona Senate tried, but failed, to hold the Maricopa County Board of Supervisors in contempt for refusing to comply with a subpoena for their voting machines so they could conduct an audit, even though no fraud was detected.

In 2022, legislators tried to grant themselves power to overturn election results.

  • In February of 2022, State Rep. John Fillmore and 14 other legislators sponsored a bill that would have given the state legislature the right to overturn a certified election, including the following provisions:
    • Require that ballots for all future elections be counted by hand;
    • Mandate that votes· be cast only on Election Day;
    • Repeal laws allowing anyone to get an early ballot without a specific reason; and
    • Restrict people to voting only in their home precinct.

State Leadership Continues to Promote QAnon Conspiracy Theory

State Senate Minority Whip Sonny Borrelli and State Senator Wendy Rogers attended QAnon events in 2021.

  • Sonny Borrelli attended the Western Conservative Action Network conference, where they spread misinformation about COVID-19, vaccines and the 2020 election. In addition, there were many references made to the QAnon conspiracy theory.
  • Wendy Rogers also attended and was a featured speaker at QAnon conventions in Las Vegas and Salt Lake City. Senator Rogers was among four other Arizona Legislators to attend and speak to the crowd in Las Vegas.
